Studies the primary legal issues correctional personnel will be entrusted to enforce and safeguard. Covers an overview of U.S. Constitutional law, the court process from arrest through trial, the structure and function of the S.S. and state courts, and prisoner rights.

Outcomes and Objectives - Demonstrate understanding of the American judicial system's foundations.
- List and define the Bill of Rights
- Demonstrate and understanding of search and seizure laws
- Define cruel and unusual punishment
- Explain the nature and role of search warrants
- Describe how and why warrants are issued
- Distinguish between State & Federal laws
- Explain the concept of incorporation and the significance of the 14th Amendment
- Synthesize all of the above into a comprehensive understanding of the concept of due process of law
- Demonstrate an understanding of court processes as they relate to criminal cases.
- Describe the mechanics of the arrest process
- Explain the arraignment process
- Explain the purpose of the preliminary exam
- Demonstrate an understanding of the conditions of pre-trial release and diversion
- Explain the trial process
- Explain the sentencing process
- Explain appeals process
- Synthesize all of the above and be able to trace the path of a criminal case through the court process.
- Demonstrate an understanding of Local, State, and Federal Court Systems.
- Differentiate between the role and function of the following:
- Administrative law
- Procedural law
- Substantive law
- Civil courts
- Trial courts
- Criminal courts
- Local, state & federal courts
- Define and differentiate between the various types of jurisdiction.
- Describe the structure and function of the federal court system including District, Appeals, and the Supreme Court.
- Demonstrate an understanding of the legal rights of correctional inmates.
- List the constitutional rights of the offender.
- Describe remedies available for alleged violations of inmates’ rights.
- Define the purpose and function of:
- Writ habeas corpus
- Writ of certiorari
- Writ of mandamus
- Explain the purpose and function of court orders.
- Differentiate between due process & institutional due process.
- Demonstrate and understanding of Section 42, 1983.
- Define staff negligence.
- Analyze and assess recent court cases related to prisoner lawsuits and Section 42.
- Synthesize all of the above and demonstrate an understanding of the ethical and legal responsibilities of correctional personnel.
- Perform writing tasks to promote learning of concepts.
- Document attainment of skills learned.
- Demonstrate knowledge of the subject.
