Delta College Student Financial Responsibility Agreement

Financial Account / Commitment to Pay
- I understand that when I register for any class at Delta College or receive a service for which Delta College charges a fee, I accept full responsibility to pay all tuition, fees and other associated costs assessed as a result of my registration and/or receipt of services.
- I understand that if I register for classes, and do not plan to attend, it is my responsibility to drop the classes, or I may owe a balance. I further understand the registration fee is non-refundable.
- I understand and agree that my registration and acceptance of these terms constitutes a promissory note agreement (i.e., a financial obligation in the form of an educational loan as defined by the U.S. Bankruptcy Code at 11 U.S.C. §523(a)(8)) in which Delta College is providing me educational services, deferring some or all of my payment obligation for those services, and I promise to pay for all assessed tuition, fees and other associated costs by the published or assigned due date.
- I understand and agree that if I drop or withdraw from some or all of the classes for which I register, I will be responsible for paying all or a portion of tuition and fees in accordance with the published tuition refund schedule Refund Policy and Tuition and Fees Payment. I have read the terms and conditions of the published tuition and refund schedule and understand those terms are incorporated herein by reference.
- I further understand that my failure to attend class or receive a bill does not absolve me of my financial responsibility as described above.
- I understand that administrative, clerical or technical billing errors do not absolve me of my financial responsibility to pay the correct amount of tuition, fees and other associated financial obligations assessed as a result of my registration at Delta College.
Method of Communication and Billing
- I understand that Delta College uses my Delta College e-mail as the official method of communication with me, and therefore I am responsible for reading the e-mails I receive from Delta College on a timely basis. I consent to receiving all communication to me via email and waive any obligation by Delta College, if any, to send me communications by regular mail or other communication method.
- I understand that Delta College uses electronic billing as its official billing method, and therefore I am responsible for viewing my Student Billing Statement under Self-Service and paying my account balance by the payment deadline date. I further understand and agree that failure to review my account statement does not constitute a valid reason for not paying my bill on time. - I authorize Delta College and its agents and contractors to contact me at my current and any future cellular phone number(s), email address(es) or wireless device(s) regarding my student account(s)/loan(s), and any other debt I owe to Delta College. I authorize Delta College and its agents and contractors to use automated telephone dialing equipment, artificial or pre-recorded voice or text messages, and personal calls and emails, in their efforts to contact me.
- I understand that I may withdraw my consent to call my cellular phone by submitting my request in writing to Delta College's Registrar's Office, or in writing to the applicable contractor or agent contacting me on behalf of Delta College.
Financial Aid – Grants, Scholarships & Loans
- I understand that aid described as estimated, anticipated or disbursed does not represent actual or guaranteed payment, but is an estimate of the aid I may receive if I meet all requirements stipulated by that aid program.
- I understand and agree that my Financial Aid Award is contingent upon my continued enrollment and attendance in each class upon which my financial aid eligibility was calculated. If I drop any class before completion or make class changes after the semester has started, I understand that my financial aid eligibility may decrease, and some or all of the financial aid awarded to me may be revoked. If financial aid award recalculations result in a balance owed to the College, I understand that I am responsible to pay such balance.
- I authorize Delta College to apply my Title IV financial aid to other charges assessed to my student account such as bookstore charges, service fees and fines, and any other education related charges.
- I understand and agree that all financial aid awarded to me by Delta College will be credited to my student account and applied toward any outstanding balance.
- I understand that receipt of an award, scholarship or grant is considered a financial resource according to Federal Title IV financial aid regulations, and may therefore reduce my eligibility for other federal and/or state financial aid.
Returned Payments/Failed Payment Agreements
- If a payment made to my student account is returned unpaid by the bank for any reason, I agree to repay the original amount of the payment, and I further understand that I may be assessed a returned payment fee of $25.
- I understand that multiple returned payments and/or failure to comply with the terms of any payment plan or agreement I sign with Delta College may result in financial restrictions, which may prevent me from registering in future classes at Delta College, or obtaining my transcripts.
Delinquent Account/Collection
- I understand and agree that if I fail to pay my student account bill or any monies due and owing Delta College by the scheduled due date, Delta College may place a financial restriction on my student account, preventing me from receiving transcripts, registering for any additional classes, changing class schedule, participating in commencement and receiving my diploma.
- I understand and accept that if I fail to pay my student account bill or any monies due and owing Delta College by the scheduled due date, and fail to make acceptable payment arrangements to bring my account current, Delta College may refer my delinquent account to a collection agency. I further understand and agree that if Delta College refers my student account balance to a third party for collection, a collection fee of 33.3% of the outstanding balance will be assessed, added to the outstanding balance, and become immediately due and payable in full at the time of the referral to the third party.
- I understand that Delta College reserves the right, in its sole discretion, to determine whether a proposed payment arrangement is acceptable.
- I understand that my delinquent account may be reported to one or more of the national credit bureaus.
- I understand that Delta College will, if and to the extent applicable, comply with the provisions of the Fair Debt Collections Practices Act, 15 U.S.C. § 1692 et seq., and any other applicable statutes, rules and regulations governing collection activities.
Student Account
- I understand and agree that I am responsible for keeping Delta College records up to date with my current physical addresses, email addresses, and phone numbers by submitting an Address Change Form to the Registrar's Office.
- Upon leaving Delta College for any reason, it is my responsibility to provide Delta College with updated contact information for purposes of continued communication regarding any amounts that remain due and owing to Delta College.
Privacy Rights and Responsibilities
- I understand that Delta College is bound by the Family Educational Rights and Privacy Act (FERPA) which prohibits Delta College from releasing any information from my educational record without my written permission FERPA Release Form.
- I understand that I may revoke my permission at any time by submitting a new FERPA Release Form indicating the date that the permission should be revoked.
IRS Form 1098-T
- I agree to provide my Social Security number (SSN) or taxpayer identification number (TIN) to Delta College upon request as required by Internal Revenue Service (IRS) regulations for Form 1098-T reporting purposes. If I fail to provide my SSN or TIN to Delta College, I agree to pay any and all IRS fines assessed as a result of my missing SSN/TIN.
- I understand that I may consent to receive my annual IRS Form 1098-T, Tuition Statement, electronically from Delta College and that if I do not give such consent, a paper copy will be sent to me by mail. - I understand that I can withdraw this consent and request a paper copy at any time.
- I understand that in some instances that I may be excluded from receiving a 1098-T per IRS regulations for a particular tax year, and therefore Delta College would not produce a 1098-T for that particular tax year.
Student Age
- I understand and agree that, if I am younger than the applicable age of majority (age 18) when I execute this agreement, the educational services provided by Delta College are a necessity, and I am contractually obligated to comply with the terms of this agreement.
Entire Agreement
- This agreement supersedes all prior understandings, representations, negotiations and correspondence between the student and Delta College, constitutes the entire agreement between the parties with respect to the matters described, and shall not be modified or affected by any course of dealing or course of performance. This agreement may be modified by Delta College if the modification is signed by me. Any modification is specifically limited to those policies and/or terms addressed in the modification.
Electronic Acceptance
- By clicking the Submit button on this agreement, you acknowledge that you have read, understand and will comply with the DELTA COLLEGE STUDENT FINANCIAL RESPONSIBILITY AGREEMENT.
